M403 Proposed Rule Change

Medical Marijuana Sales General Limitations – M403 Proposed Rule Change.

Cannabis Regulatory Solutions wants all of our clients to know that the MED has proposed (1) broadening the definition of “Medical Marijuana” to specifically include Medical Marijuana Concentrate (see definitions) and (2) removing the confusing statement in regard to “medical marijuana equivalents” contained within the existing Rule M403.

If adopted, the proposed changes would provide clarity that Medical Marijuana Centers are limited to selling up to two ounces of medical marijuana (including medical marijuana concentrate) during a single sales transaction UNLESS the patient has designated the center as his/her primary center AND supplied documentation from the patient’s physician allowing more than two ounces. 

The M403 proposed rule change should be viewed as very good news.  They fulfill the ongoing needs of seriously ill medical marijuana patients while clarifying what has been very a confusing and misunderstood issue.  Additional changes have been written into M403.  Readers are encouraged to review them.
